Dan on ‘American Sniper’ Interrogation Tapes Played in Court

CaptureDan appeared on Good Morning America, Tuesday, February 17th to discuss the ongoing trial of Eddie Ray Routh, the man accused of killing American Sniper, Chris Kyle and his friend Chad Littlefield. The jury has heard Routh’s confession videotaped hours after he gunned down Kyle and Littlefield and it could very well undermine his insanity defense. Dan commented, “While this is not helpful to his defense at all, this idea of him coming forward repeatedly… if he is legally insane, he’s not the guy to ask. Right? I mean, as a legal and practical matter, if he doesn’t understand right from wrong asking that guy isn’t the right person to be asking about that. You have to look at the tape in its totality about 50 something minutes long. There are a number of periods in there where he seems sort of incoherent talking about head hunters and saving his soul. He’s talking about needing to do it. Insanity always really, really tough to win but the defense hoping they focus on sort of the totality of the tape” Watch the full clip here.

Dan on Alleged ‘American Sniper’ Killer’s Defense

CaptureDan appeared on Good Morning America, alongside of HLN’s Nancy Grace, Thursday, February 12th to discuss the trial of Eddie Ray Routh. Routh is the man accused of killing ‘American Sniper’, Chris Kyle and friend Chad Littlefield on February 2, 2013, at a Texas gun range. Routh is planning on an insanity defense citing PTSD as a key factor in his not guilty plea… but is that enough? Says Dan,  “PTSD is not enough to say I shouldn’t be held responsible for my actions. It has to be my PTSD was so bad that I didn’t understand right from wrong. But, look, in this case, this is a comparatively good insanity claim and what I mean by that is the insanity defense is always tough… but they have evidence here of not just mental illness, but of comments he made afterwards that may suggest that he didn’t understand what he did was so terrible. That’s the important thing in this case and to have the victim himself having said this dude is straight up nuts… that’s not a legal or medical assessment but is sure helpful to the defense.” Watch the full clip here.

Dan on American Sniper Trial

CaptureDan contributed to a segment for ABC’s World News Tonight as well as Good Morning America on the trial of Eddie Ray Routh, the man accused of killing American Sniper, Chris Kyle and Kyle’s friend Chad Littlefield. The jury has been selected and opening statements begin Wednesday, February 11th. Selecting an unbiased jury was not an easy task as Kyle’s book has gained mass popularity following the Oscar-nominated movie, American Sniper, based on his memoir. Routh’s defense has made it clear they will be pursuing an insanity defense and prosecutors have said they will not be seeking the death penalty. Dan commented, “Just saying you’re suffering from Post Traumatic Stress Disorder is not enough to get a not guilty by reason of insanity verdict, you have to literally be able to show that the defendant did not understand right from wrong…” Watch the full clip here.
